Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period : the period during which the consumer may exercise their right of withdrawal;
Consumer : a natural person who is not acting in the course of a profession or business and who enters into a distance contract with the entrepreneur;
Day : calendar day;
Long-term transaction : a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
Durable data carrier : any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal : the option for the consumer to cancel the distance contract within the cooling-off period;
Entrepreneur : the natural or legal person who offers products and/or services remotely to consumers;
Distance contract : an agreement whereby, within the framework of a system organized by the entrepreneur for the remote sale of products and/or services, exclusive use is made of one or more techniques of distance communication up to and including the conclusion of the agreement;
Distance communication technology : a means that can be used to conclude an agreement without the consumer and entrepreneur being together in the same place at the same time.
General Terms and Conditions : the present General Terms and Conditions of the entrepreneur.

Article 3 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the conclusion of the distance contract that the general terms and conditions can be consulted at the entrepreneur’s premises and that they will be sent free of charge as soon as possible at the consumer’s request.
If the distance contract is concluded electronically, notwithstanding the previous paragraph and before the conclusion of the distance contract, the text of these general terms and conditions may be made available electronically in such a way that it can be easily stored by the consumer on a durable data carrier. If this is not reasonably possible, it will be indicated where the general terms and conditions can be consulted electronically and that they will be sent free of charge electronically or otherwise at the consumer’s request.
If, in addition to these general terms and conditions, specific product or service conditions also apply, the second and third paragraphs apply mutatis mutandis and, in the event of conflicting conditions, the consumer may always rely on the provision that is most favorable to them.
If one or more provisions of these general terms and conditions are at any time wholly or partially void or annulled, the remainder of the agreement and these terms and conditions shall remain in force and the relevant provision shall be replaced by mutual agreement with a provision that approximates the original as closely as possible.
Situations not covered by these general terms and conditions must be assessed “in the spirit” of these general terms and conditions.
Any ambiguities regarding the interpretation or content of one or more provisions of our terms and conditions shall be interpreted “in the spirit” of these general terms and conditions.
Article 4 – The Offer
If an offer has a limited period of validity or is subject to conditions, this will be expressly stated in the offer.
The offer is non-binding. The entrepreneur is entitled to modify and adjust the offer.
The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer. If the entrepreneur uses images, they are a true representation of the products and/or services offered. Obvious mistakes or errors in the offer are not binding on the entrepreneur.
All images and specifications in the offer are indicative and cannot give rise to compensation or termination of the agreement.
Product images are a true representation of the products offered. The entrepreneur cannot guarantee that the colors displayed exactly match the actual colors of the products.
Each offer contains such information that it is clear to the consumer what rights and obligations are attached to acceptance of the offer. This includes in particular:
- the price, excluding customs clearance costs and import VAT. These additional costs are at the customer’s expense and risk. The postal and/or courier service will apply the special scheme for postal and courier services with regard to imports. This scheme applies if the goods are imported into the destination EU country, which is the case here. The postal and/or courier service collects the VAT (whether or not together with the customs clearance fees charged) from the recipient of the goods;
- any shipping costs;
- the manner in which the agreement will be concluded and what actions are required for that purpose;
- whether or not the right of withdrawal applies;
- the method of payment, delivery, and performance of the agreement;
- the period for accepting the offer or the period during which the entrepreneur guarantees the price;
- the rate for distance communication if the costs of using the technology for distance communication are calculated on a basis other than the regular basic rate for the communication method used;
- whether the contract will be archived after its conclusion and, if so, how it can be consulted by the consumer;
- the way in which the consumer can check and, if desired, correct the data provided in connection with the agreement before concluding the contract;
- any other languages in which, in addition to Dutch, the agreement may be concluded;
- the codes of conduct to which the entrepreneur has submitted and how the consumer can consult these codes electronically; and
- the minimum duration of the distance contract in the case of a long-term transaction.
